renewables

McMillan's Electricity practice is particularly focused on renewable energy projects, with extensive experience working on wind, solar, biomass, biogas and hydro-electric projects.

In addition to serving as counsel to both the Canadian Solar Industries Association (CanSIA) and the Ontario Energy Association (OEA), we also acted as counsel to the Ontario Power Authority in drafting the rules and contract for Canada's first Renewable Energy Standard Offer Program.

We have since acted for participants in RFPs and Clean Energy Calls in most of Canada's ten provinces.

Our large volume of clients in the wind and solar sectors led us to develop template forms of wind lease options and easements, as well a standard form solar rooftop lease that can be used by developers in their rooftop leasing programs. We have also acted for landowners and landlords in preserving their rights under similar leases and easements. Our extensive renewable leasing experience is matched by our experience with EPC contracts for solar projects, having drafted EPCs for dozens of megawatts of PV projects.

We regularly assist clients participating in Ontario's FIT Program and in RFPs and Calls for Tender in other provinces. We provide advice in the Renewable Energy Approval and other environmental approval processes, as well as in dealing with distributors and transmitters in respect of grid connection. We are familiar with both the ecoEnergy and ecoLogo programs and requirements.

We negotiate equity and debt financings for investors, developers, borrowers and lenders, can help to ensure that projects are "financeable" from the perspective of each group, and have performed due diligence for hundreds of megawatts of renewable projects.

We have also acted for several electricity retailers in various provinces in the purchase and sale of green power and renewable energy credits.
