A growing area of liability for employers, harassment and discrimination claims pose a financial and reputational risk to businesses.  Our group advises its management clients on establishing effective workplace policies that are suitable for the employer's business while being compliant with applicable laws. Our group also regularly advises on the conduct of workplace investigations into allegations of harassment and discrimination, as well as assisting clients in determining the best steps in resolving those allegations.

In addition, as short-term and long-term disability claims increase, managing employee absences and the accommodation process have become important components of a human resources professional's job. The leave and accommodation process is time-consuming and fraught with danger as claims of harassment and discrimination are common in this area. Our lawyers can assist clients in managing this process, from drafting comprehensive short and long-term disability leave policies that ensure effective communication and management, to establishing return-to-work plans and accommodation steps. Our lawyers are experienced in dealing with issues of malingering and abuse of sick leave benefits and can assist a client in investigating such misconduct.

When a claim of harassment or discrimination is filed at a human rights tribunal or in court, our experienced litigators can assist in responding to those claims and advocating on behalf of the client. We have successfully defended clients in front of provincial and federal human rights commissions and tribunals as well as defended harassment and discrimination claims made in connection with wrongful dismissal actions.
