government procurement
McMillan can help you with your government procurement issues.
The lawyers at McMillan are experienced in public procurement matters, including the preparation and presentation of submissions to Federal Government Departments, such as Public Works and Government Services Canada (PWGSC), and National Décence.
We assist in preparing bids and proposals, draft procurement guidelines, and advise and represent clients in challenges of unfavourable procurement decisions to the Canadian International Trade Tribunal (CITT) and the Federal Court of Canada. In particular, we provide advice on the legal requirements arising in tender documents, including Request for Proposals (RFP), and Request for Supply Arrangements (RFSA).
We advise clients on all steps of the procurement process:
- Bid preparation and submission
- Compliance with the tender documents (such as RFP and RFSA)
- Review of the tendering process
- Communications with the procuring department
- Debriefing meetings with the procuring department
- Challenges of unfavourable procurement decisions to the CITT and the Federal Court
- Representation as intervener to defend the interests of the winning bidder
- Submissions on cost and compensation
- Compliance throughout delivery of the tendering contract
Our lawyers have particular expertise in international agreements dealing with procurement, such as the Agreement on Government Procurement under the WTO, Chapter 10 (Government Procurement) of NAFTA, and Chapter 5 (Procurement) of the Canadian Agreement on Internal Trade. They have practical experience with specific rules dealing with procurement, such as Treasury Board and PWGSC guidelines, Canadian International Tribunal Act, Canadian International Trade Tribunal Procurement Inquiry Regulations, and Canadian International Trade Tribunal Rules. They are also well versed with changes introduced in the procurement process through the introduction of the proposed Federal Accountability Act.
McMillan LLP has worked with all levels of government, in both official languages, to further the interests of our clients. Because of our extensive network of contacts in Canada's capital, we can offer not only legal knowledge and experience, but also insights into, and liaison with, the appropriate authority and representative, whether bureaucratic or political.
