Professional Experience

Dan practises all aspects of commercial litigation. He has appeared in all levels of court including The Ontario Court of Appeal, the Federal Court of Appeal and the Supreme Court of Canada. He also has extensive experience in complex domestic and international arbitration proceedings, both as counsel and as an arbitrator. Dan also has involvement in insurance litigation including coverage disputes in relation to various types of policies including professional liability, environmental claims and fidelity bonds.

He has been involved extensively in general commercial litigation related to banks and other financial institutions and insolvency and restructuring litigation on behalf of creditors, debtors and court appointed officials.

Dan served as National Litigation Coordinator and Chair of McMillan's litigation practice from 2005 to 2011.  At the present time he also serves as Chief Risk Partner and General Counsel for McMillan.

Dan has served as Section Leader and Guest Instructor at Osgoode Hall Law School's Intensive Trial Advocacy Program and frequently speaks at seminars and conferences concerning civil procedure, litigation, risk management and alternative dispute resolution.

Representative Transactions

  • Acted for a syndicate of Canadian and foreign banks in $US 1.2 billion breach of contract, misrepresentation and oppression claim against BCE Inc.
  • Represented the Michigan Commissioner of Insurance in a breach of trust claim against Confederation Treasury Services and in cross-border insolvency proceedings involving Confederation Life Insurance Company
  • Acted for Makivik Corporation on behalf of the Inuit of Northern Quebec in overlapping land claim negotiations and with respect to offshore claims
  • Acted for First Air in commercial litigation matters and in the Air Canada restructuring
  • Acted for financial institutions in major insolvency proceedings involving Air Canada, Trident, Stelco and Ivaco and acted for trustee in bankruptcy in connection with the insolvency of Canada 3000
  • Acted for financial institutions and accounting firms in complex receivership proceedings involving Rose Park Wellesley and State Group
  • Acted for the Canadian Civil Liberties Association in a Canadian Charter of Rights and Freedoms case in the Ontario Court of Appeal and the Supreme Court of Canada
